Effective Date: September 2020
The Nielsen Company (US), LLC and its affiliated companies and subsidiaries ("Nielsen," "we," or "us") takes your
privacy very seriously and is committed to handling your data in an open and
transparent manner.
As the
controller of the personal data that is processed in connection with your use
of the VizIt mobile application (the "App"), we have created this Privacy
Notice to explain how we will use, share, and protect the data we may collect
or otherwise obtain about you when you use the App and when we perform any
activities that form part of the operation of the App. This Privacy Notice also
describes your choices and legal rights in relation to such data.
Please note
that this Privacy Notice applies only to data collected by us in connection
with your use of and interaction with the App and through our performance of
any activities that form part of the operation of the App. This Privacy Notice
does not apply to data collected directly by other parties, such as our
licensed clients or our partners, for their own purposes. Additionally, this
Privacy Notice does not apply to your participation in any Nielsen studies,
panels, or surveys or your use of any other applications, websites, or online
services administered or provided by any entity within the Nielsen
group of companies. Other applications and websites, including
applications and websites provided by entities within the Nielsen group of
companies and websites that may be accessible via the App, are governed by
their own privacy notices. We encourage you to review all applicable privacy
notices before disclosing any data.
The App is not designed to affect your mobile device experience or conflict
with other software you have running on your mobile device.
Use of the App
is voluntary. By downloading and installing the App on your device, you agree
that we can collect, use, disclose, and retain your data as described in this
Privacy Notice. If you have any questions about this Privacy Notice or your
data, please refer to the "Contact us" section below for our contact

Collection of your data
We may collect or otherwise obtain data relating to you, your mobile device,
and your use of the App in a variety of ways. The data that we collect or
obtain may include personal data - data
that alone or in combination with other data identifies you as an individual,
such as your name, email address, mobile phone number, device identifier, and
other data that can be reasonably linked to you as an individual.
Additional details about the data we may collect or otherwise obtain and our
data sources can be found below.
Data collected from you
During the user
registration process, we will gather demographic data about you through the
voluntary completion of a questionnaire, such as your gender, age, occupation,
and country/city of residence.
Once you have
become a registered user of the App, we may, from time to time, ask you to
complete daily surveys in the App for a certain period. These surveys are
designed to collect data about your behavior and preferences in order to help
us better understand consumer behavior and trends.
Some of the features
on our App may require access to the camera of your mobile device. You must
give your permission before we access your device's camera, and you can adjust
the settings of your device at any time to control access to your camera. When you use the App, we will
also obtain data that you provide to us, enable us to collect, or voluntarily
post or upload, including receipt images and anything else that you decide to
post or upload (e.g., messages/comments, videos, recordings, etc.).
If you give us
permission, when you use the App we may receive data about the geolocation of
your mobile device through various means depending on the device you are using,
including Global Positioning System ("GPS"). We collect this data in order to
personalize our services. The collection of your mobile device's geolocation
will occur only when you launch the App. You may choose to stop our collection
of your mobile device's geolocation at any time through your device's system
settings or by removing the App from your device.
We do not seek
sensitive personal data (e.g., data relating to an individual's racial or
ethnic origin, political opinions, religious or other similar beliefs, health
or medical conditions, criminal background, or trade union membership) from
users of the App. We ask that users of the App not share any sensitive personal
data with us or post or upload such data to the App. If you voluntarily provide
sensitive personal data for any reason or we are required to collect such data
as a result of legal requirements imposed on us, we will, where necessary,
obtain your explicit consent and use such data in accordance with this Privacy
Notice and applicable law.
Data obtained from other parties
We may receive
certain data about you from third parties (e.g., third-party research panel
providers) that have a legal right to provide such data to us. Where
applicable, we will use the data obtained from other parties only for the
purposes described in this Privacy Notice.
Data collected in connection with your

features and functionality and collect additional data that helps us improve
the App and better deliver our services to you. Specifically, we may use
cookies to identify your browser or device, display information more

We will use
your data for the purpose(s) for which it was collected or provided to us (as
stated above in the "Collection of your data" section or at the point of

prevent, investigate, take action regarding or provide notice of
fraud; unlawful or criminal activity; other misconduct; security or technical
issues; or unauthorized access to or use of data, the App, or our data systems;
●
protect the rights, property, operations, health, or safety of
you, us (or those of one of more other entities within the Nielsen group of

of one or more other entities within the Nielsen group of companies;

personal data collected from or about you.
Legal basis for processing your personal
data
Applicable law
in your country of residence may require us to set out in this Privacy Notice
the legal basis upon which we rely in order to process your personal data.

Economic Area ("EEA"), we will
process your personal data for the purposes outlined in this Privacy Notice
based on one or more of the legal bases listed below.
●
Legitimate interests: We rely on our legitimate
interests, provided that such interests shall not be overridden by your
interests, fundamental rights, or freedoms. In particular, among other things,

●
Consent: We may process your

Compliance with legal
obligations:
We may process your personal data if necessary for us to comply with a legal
obligation arising under applicable law to which we are subject.

competent governmental and public authorities, in each case to
comply with legal or regulatory obligations or requests or for the purposes of
reporting any actual or suspected breach of applicable law; and
●
other third parties as we believe necessary
(e.g., in order to protect the rights, property, operations, health, or safety
of you, us, or others) or appropriate for legal purposes (e.g., in connection
with claims, disputes, or litigation or in order to enforce our legal
rights).
Due to the
international nature of our business, the disclosures described above may
result in the transfer of your personal data to countries or regions with data
protection or privacy laws that differ from those in your country of residence.
By providing us with your personal data and/or using the App, you are
acknowledging that your personal data may be
transferred to countries outside of your country of residence. In cases where
your personal data is transferred outside of your country of residence, we will
ensure that there are adequate safeguards in place to protect your personal
data.
Additional information for EU/EEA
residents
If you are
based in the EU/EEA and your personal data will be transferred to a country
that has not been recognized by the European Commission as providing an
adequate level of data protection, the safeguards put in place might include a
data transfer agreement with the data recipient based on standard contractual
clauses approved by the European Commission for transfers of personal data to
countries not providing an adequate level of data protection. Alternatively, in
certain circumstances, we may transfer your personal data on the basis of a

measures designed to protect your data from loss, misuse, and unauthorized
access, disclosure, alteration, or destruction while it is under our control.
However, please be aware that the storage and transfer of data cannot always be
one-hundred percent secure.
Data retention
We will retain
your data in a form that permits identification only for as long as necessary
for the fulfillment of the purposes set out in this Privacy Notice, unless a
longer retention period is required under applicable law or is necessary in
order to resolve disputes, protect our legal rights, or otherwise to comply
with our legal or professional obligations.
Additional information for EU/EEA
residents
Where we are
processing your personal data based on our legitimate interests, we generally
will retain your data for a reasonable period of time based on the particular
interest, taking into account your interests, fundamental rights, and/or
freedoms.
Where we are
processing your personal data based on your consent, we generally will retain
such data for the period of time necessary to carry out the processing
activities to which you have consented, subject to your right, under certain
circumstances, to have certain of your personal data erased (see the "Your
